These terms govern the relationship between Jackson Concrete Company(referred to as "we," "us," or "the company") and any person or entity that contacts us, receives an estimate, or hires us to perform concrete work (referred to as "you" or "the client").
Jackson Concrete Company provides concrete contractor services including, but not limited to: driveway installation and replacement, patio construction, foundation work, slab installation, sidewalk building, stamped and decorative concrete, concrete cutting, retaining walls, pool decks, and related flatwork. Services are delivered in Jackson, TN and surrounding Tennessee communities.
All work is performed by or under the supervision of licensed Tennessee concrete contractors. We reserve the right to decline any project at our discretion.
All estimates are based on an on-site assessment of the project conditions at the time of the visit. Written estimates are valid for 30 days from the date issued unless otherwise noted.
Estimates include the scope of work, materials, and labor as described in the written proposal. Items not listed in the written estimate are not included. If conditions discovered during the project require additional work not covered in the original estimate - such as unexpected soil conditions, buried obstructions, or utility conflicts - we will notify you before proceeding and provide a written change order with updated pricing.
Verbal estimates or price quotes provided before an on-site assessment are approximations only and are not binding.
Project start dates are confirmed in writing after acceptance of a written proposal. Start dates are subject to weather, material availability, and scheduling constraints. Concrete cannot be poured safely in certain weather conditions, including rain, extreme cold, or extreme heat, and we reserve the right to reschedule accordingly.
If you need to cancel or postpone a scheduled project, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start date may result in a cancellation fee to cover materials already ordered or labor pre-committed to your job.
If a deposit has been paid and you cancel the project before work begins, the refundable portion of the deposit will be determined based on any costs already incurred by the company in preparation for the job.
Payment terms are as follows unless a different arrangement is stated in writing in your project proposal:
Invoices not paid within 15 days of the due date may be subject to a late fee. Accounts more than 30 days past due may be referred to a collections process and may incur additional costs including reasonable attorney fees and court costs if legal action is necessary to collect payment.
We reserve the right to place a mechanic's lien on the property in accordance with Tennessee law if payment is not received for completed work.

Jackson Concrete Company is not liable for damage to unmarked or improperly marked utilities.
We stand behind the quality of our work. If a material defect or workmanship issue arises within one year of project completion, we will assess the issue and, where we determine the problem is attributable to our work, we will make it right at no additional cost to you.

Our total liability for any claim arising from a specific project will not exceed the amount paid by the client for that project.

If direct resolution is not possible, both parties agree to attempt mediation through a neutral third party in Madison County, Tennessee before initiating legal proceedings. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Madison County, Tennessee, and you consent to the personal jurisdiction of those courts.
